Mr. Burell,
It is not our practice to respond to scurrilous “reports,” however I do advise you that (a) SeaEscape absolutely does not condone immigration fraud and statements and implications to the contrary are actionable; (b) much of what you state here is either untrue or unknown to us and believed to be baseless; and (c) if information is disseminated that is libelous, slanderous, or defamatory, we will pursue all legal and equitable remedies available to us.
Sincerely,
Judith A. Jarvis
Vice President of Legal Affairs

Responding to an official request for comment, above is what we received from The SeaEscape group of Companies. To this we reply:
A) According to their statement, naturally SeaEscape does not "condone immigration fraud." Yet we have abundant proof that all allegations made against your partner Poseidon International Maritime Inc. headed by Peter Lobnig stand. For this we have abundant evidence. Legally for you it is wise to hold to the phrase "SeaEscape absolutely does not condone immigration fraud." Which is precisely how I framed the email to you in an effort to receive feedback for errors of fact, as I expressed.
From your position you acknowledge ignorance of the alleged illegal conduct, yet we find it incredible to believe that Poseidon International could have acted alone in this redundant immigration fraud. Are there no checks and balances in place for SeaEscape which prevent foreign worker visa holders to leave the ship which was docked in Port Everglades? MV/ Island Adventure to be specific. At the behest of the Lobnig's, work visa holders unlawfully traveled to Miami and Doral Florida to inventory, pack and ship illegally marketed and sold wines, which is clearly and legally beyond the scope of their federally issued foreign worker visa provisions. As you are aware geographical restrictions are imposed on those foreign workers which do not extend beyond Ft. Lauderdale, not to mention the onboard job description which those workers were obliged to honor, otherwise it violates their employment contract. Scurrilous is your partner Peter Lobnig and your half hearted attempt to defend his position by choosing to consider the alleged conduct baseless.
(B) Without being specific you reply: "much of what you state here is either untrue or unknown to us and believed to be baseless." If you decide to be more specific about what you consider is untrue as it relates to SeaEscape, excluding that you don't "condone immigration fraud" then we are open for correction. If you choose to disbelieve or consider "baseless" the overall fact pattern of the story, the character and dealings of the Lobnig's which has been firmly settled in other published and current legal accounts, then that is your choice. There are real people suffering as a consequence of the Lobnig's well documented, unscrupulous lies and scurrilous deceptions. The odd element here is that those same people tried to help the Lobnig's during a time of crisis.
(C). My reply, refer to A&B.
Kindly,
Tom Burell
